Galaxy Construction and Transportation Services Limited has accused the Economic and Financial Crimes Commission (EFCC) of abusing court processes to confiscate its properties.
The company made this allegation in a statement while reacting to a Federal High Court Abuja ruling granting the EFCC’s prayer for a final forfeiture of several assets.
Illegal Forfeiture Order
According to the company’s Executive Chairman, Mr. Babagana Dalori, the assets include N335 million cash, a hospital, and five filling stations.
Dalori described the forfeiture order as “illegal,” claiming that a competent court of coordinate jurisdiction had previously set aside an interim forfeiture order obtained by the EFCC.
Dalori alleged that the EFCC’s lawyer, Fadila Yusuf, was aware of the development but proceeded to file a motion to set aside the judgment, only to abandon it midway and initiate a fresh ex parte application in a different court.
He stated, “This is a classic case of forum shopping, which is an abuse of court process.”
The affected properties include several plots of land, residential apartments, a hospital, and filling stations across various states in Nigeria.
Dalori assured the public that the company would pursue the ongoing legal process, saying, “We call on the general public and all concerned parties to remain calm and await the outcome of the ongoing legal process that the truth will ultimately prevail.”
*EFCC’s Response*
In response, the EFCC’s Head of Media and Publicity, Dele Oyewale, maintained that the commission followed every legal procedure in securing both interim and final forfeitures of the assets.
Oyewale described the company’s actions as “ridiculous and untenable,” stating that the commission would enforce the forfeiture orders.
