High Court in Minna has granted an interim injunction restraining the suspension and potential impeachment of Aminu Yakubu-Ladan, Chairman of Chanchaga Local Government in Niger State.
Justice Mohammed Mohamed presided over the court session, delivering the ruling on Friday.
Allegations of Misconduct
The legislative arm of the council had served a notice of suspension on the chairman, citing allegations of misconduct and abuse of office.
The notice, signed by 10 members of the legislative arm, sparked a heated controversy that led to the court battle.
Court’s Ruling
The judge restrained the 1st to 10th defendants from acting on or taking further actions on the suspension notice, pending the hearing and determination of the motion on notice.
Additionally, the court granted an interim order restraining the 1st to 11th defendants from initiating or commencing any process to remove the plaintiff (chairman) from office.
Chairman’s Legal Action
The chairman had earlier filed a suit at the Federal High Court in Abuja, seeking to restrain the Niger State Independent Electoral Commission (NSIEC) and others from conducting a scheduled local government election until the expiration of council chairmen’s tenure.
The NSIEC had fixed November 1 for the conduct of the local government poll across the state.
*Implications of the Ruling*
The court’s decision has significant implications for the political landscape of Niger State.
The interim injunction allows the chairman to continue performing his duties without interruption, at least until the next court hearing on August 6.
*Next Steps*
The case has been adjourned to August 6 for hearing, where the court will determine the fate of the chairman’s suspension and potential impeachment.
The outcome of the case will have far-reaching consequences for the chairman, the legislative arm of the council, and the people of Chanchaga Local Government Area.
