Appeal Court affirms Hon. Ibrahim as duly elected member for Sabon Birnin South constituency of Sokoto

The Court of Appeal sitting in Abuja on Thursday, affirmed the election of Hon Ibrahim Saidu Naino of the All Progressive Congress (APC) as the member representing Sabon Birnin South constituency of Sokoto State.

In a unanimous judgment of a three-member panel of Justices of appellate court delivered by Justice Oyebisi Omoleye, the court upheld the judgement of the National and State Houses of Assembly Election Petition Tribunal which affirmed Naino as winner of the said election.

The appellate court held that the appeal filed by the Peoples Democratic Party (PDP) and its candidate, Umar Mahe lacks merit and consequently dismissed it.

The court further held that the lower Tribunal was right in its judgment delivered on October 2, 2023 when it dismissed the petition of the PDP and its candidate in the said election.

The appellant court agreed with the lower Tribunal that the appellant through out the trial did not present any witness to show that Hon Ibrahim who he accused of not qualified to contest the March 18, 2023 State House of Assembly election.

Court of Appeal stated that from the record and documents presented before the tribunal, the electoral commission was right when it cleared Ibrahim for the election .

The Court of Appeal added that the respondent was qualified as a candidate for the March 18, 2023 State House of Assembly election and he was duly returned haven won the majority of the lawful votes casted at the election.
