Attorney General of the Federation and Minister of Justice, Lateef Fagbemi, SAN, has clarified that no inmate has been released yet under the latest Presidential Prerogative of Mercy, as the process remains in its final stages of administrative review.
Speaking with the News Agency of Nigeria (NAN) on Thursday in Abuja, Fagbemi explained that while the Council of State has approved the list of recommended beneficiaries, official instruments of release are yet to be issued.
“It is important to note that the last stage of the exercise, after approval by the Council of State, is the issuance of the instrument for the implementation of the decision concerning each beneficiary,” Fagbemi stated.
According to him, this final phase involves careful scrutiny of the names and recommendations to ensure full compliance with the law before the list is sent to the Controller-General of Corrections for execution.
“This stage affords an opportunity for a final look at the list for remedial purposes, if any, before the instrument is forwarded… This verification process is part of the standard protocol and reflects the government’s commitment to transparency and due diligence,” he added.
Responding to public concerns and media commentary, the Justice Minister welcomed the engagement, noting that such scrutiny helps to strengthen democratic institutions.
“Public engagement is always welcome, as it demonstrates that Nigerians care deeply about justice and good governance,” he said.
He also dismissed speculation about any delay, insisting that the process is unfolding as it should — strictly in line with the law.
“There is no delay in the process; it is simply following the law to the letter to ensure that only those duly qualified benefit from the President’s mercy.
“As soon as all legal and procedural checks are concluded, the public will be duly informed. The rule of law does not rush; it ensures fairness,” Fagbemi concluded.
The Presidential Prerogative of Mercy is a constitutional power allowing the President to grant pardons or commute sentences. However, each stage — from recommendation to review, Council approval, and final endorsement — is tightly regulated to prevent abuse and ensure only deserving cases are approved.
