The Federal High Court in Abuja has granted the National Rescue Mission (NRM) permission to serve a contempt charge on the Chairman of the Independent National Electoral Commission (INEC), Prof. Yakubu Mahmood, by substituted means.
Justice Obiora Egwuatu directed that the Form 48, a notice of the consequence of disobedience of a court order, be served on Mahmood by handing it to any staff at INEC’s national headquarters.
The NRM alleged that INEC flouted a court order mandating it to accept the party’s leadership structure led by Chief Edozie Njoku.
The party’s counsel, Oladimeji Ekengba, said INEC’s refusal to comply with the judgment necessitated the contempt proceedings.
“We are seeking to serve the Form 48 on the INEC chairman to show cause why he should not be committed to prison for failing to comply with the judgment of this court,” Ekengba said.
The court adjourned the matter until July 15 for mention.
