
National Rescue Movement (NRM) has threatened to apply for a bench warrant of arrest against Prof. Mahmood Yakubu, Chairman of the Independent National Electoral Commission (INEC), over his absence in court.
NRM’s lawyer, Oladimeji Ekengba, made this statement before Justice Obiora Egwuatu of the Federal High Court in Abuja.
Ekengba expressed shock at Yakubu’s absence in a contempt proceeding, which is a criminal matter.

He argued that the contempt charge takes precedence over other matters, citing a Supreme Court decision.
Ekengba stated, “The fact is that the contemnor is not here and no reason was given.
“Otherwise, I will be applying for a bench warrant of arrest for him to be here.”
*INEC’s Response*
Yakubu’s lawyer, Alhassan Umar, SAN, informed the court that they had filed a preliminary objection to challenge the matter.
Umar argued that the application should be heard first, but Ekengba countered that a contempt charge takes precedence.
*Court’s Reaction*
Justice Egwuatu adjourned the matter until October 8 for hearing, expressing concern that INEC’s actions could make a caricature of the judicial system. The judge stated, “At least I read law. This profession is for all of us, and no matter how highly placed a person is, he would obey the law.”
