Court restrains Misau from parading himself as Bauchi APC Chairman

ARMSTRONG ALLAHMAGANI, Bauchi –

The cracks in the All Progressives Congress have continued to widen following a court order obtained by one of the chairmanship aspirants in the last state congress, Hassan Sheriff, restraining Babayo Misau, from parading himself as the chairman of the party in the state.

This followed an order granted during a Federal High Court 2 sitting last Thursday, presided by Justice Hamidu Kunaza.

The order with suit no: BA/294/2021, signed by the Assistant Registrar of the Court, Dalhatu Haruna and dated 2nd December, 2021 which was obtained by our correspondent in Bauchi was granted after Barristers H.B GHIDE with ZAINAB ZWALL moved the motion.

The court also restrained 36 others from parading themselves as executives of the APC in the state.

Joined in the suit are the APC; Chairman of the Bauchi State Screening and Selection Committee; Acting National Chairman of the APC, Mai Mala Buni; Chairman, Bauchi State APC Extended Stakeholders Committee, Adamu Adamu and Member of the APC Extended Stakeholders Committee, Yakubu Dogara, as 1st, 2nd, 3rd, 4th and 5th respondents respectively.

Also, Babayo Misau was joined as the 6th respondent while the 7th – 42nd respondents are the other executives of the APC elected on 17th October, 2021.

The order reads: “That an order of interim injunction is made restraining the 6” – 42nd Defendants/Respondents from parading themselves in whatsoever manners or means and/or acting in whatever capacities or names called as the Bauchi State Executive Officers of the 1st Defendant pending the hearing of the substantive suit already filed before this Honourable Court.

“That an order is made restraining the 1st – 5th Defendants/respondents in the interim, whether by themselves, agents, privies, cohorts and representatives in whatever capacity from administering oath of office and/or according the 6th – 42nd Defendants/Respondents recognition as the Bauchi State 1st Defendant’s Executive Officers pending the hearing and determination of the substantive suit filed before this Honourable Court between the parties.”

The matter was adjourned to 13th December, 2021 for hearing.

When contacted, the plaintiff, Sheriff told our correspondent that he got the court order because over 20 of them bought forms to contest for the chairmanship seat, but no elections were held.

“I obtained this order through my lawyers because there was no election in Bauchi during the last state congress. We were denied the opportunity of being voted for,” he said.

NATIONAL ACCORD reports that the APC in Bauchi State has been embroiled in crisis since the state congress which led to parallel elections and executives.

The parallel elections were between the faction loyal to Nigeria’s Ambassador to Germany, Yusuf Maitama-Tuggar and the one loyal to the Minister of Education, Adamu Adamu, who is the leader of the party in the state.
